This Guide provides a description of the regulatory processes used to assess and approve applications for oil and gas exploration and development in the Sahtu Settlement Area (SSA) of the Northwest Territories (NWT). ... For any particular project, the Operator will have to refer to the appropriate legislation and regulatory authorities for clarification and interpretation of specific requirements. This Guide deals strictly with authorization processes. Once a development is approved, the Operator must comply with both the terms and conditions of the authorizations and post-licencing regulations. These latter requirements are not covered by this Guide. ... This Guide has four main parts: Part 1: Introduction to the Sahtu Settlement Area. Part 2: Authorizations by Stage of Activity. Part 3: Environmental Impact Assessment Process. Part 4: Regulatory Agencies and Processes. ... Part 1 provides an overview of the legal and policy context in
the Sahtu Settlement Area, including regulatory and review bodies and their roles, and introduces the Reader to: the Sahtu Settlement Area (SSA); the Sahtu Comprehensive Land Claim Agreement (SCLCA), which takes precedence within the SSA; the ownership of surface lands and subsurface resources in the SSA; the Sahtu Dene and Metis institutions established pursuant to the SCLCA and their role in decision-making associated with oil and gas exploration and development; and the institutions of public government under the Mackenzie Valley Resource Management Act (MVRMA) and their respective roles and responsibilities. Companies wishing to work in the SSA must understand both the importance of the SCLCA to Sahtu Dene and Metis residents and the necessity of consulting closely with the Sahtu regarding their rights and interests, before any work will be authorized. Part 2 - Authorizations By Stage of Activity ... contains the first six numbered chapters
of the Guide which describe the steps in the overall authorization process .... Chapters 1 through 6 are organized to reflect the progressive sequence of activities from early exploration to production and transmission of oil and natural gas. Each Chapter consists of a flowchart, accompanied by a step by step written explanation of the procedures for reviewing and approving applications. Chapter 1: Rights to Explore and Test (Exploration Licence); Chapter 2: Geological/Geophysical Program or Drilling Operations; Chapter 3: Rights to the Resource (Significant and Commercial Discoveries, Production Licence); Chapter 4: Approval of a Development Plan; Chapter 5: Oil and Gas Production; Chapter 6: Transboundary Pipeline Approvals. Part 3 - Environmental Impact Assessment Process ... describes the mandate and processes in the SSA for preliminary screening of applications and any subsequent environmental assessment and environmental impact review.
Within the Mackenzie Valley, the Canadian Environmental Assessment Act is replaced by the environmental impact assessment process laid out in the Mackenzie Valley Resource Management Act, and administered by the Mackenzie Valley Environmental Impact Review Board (MVEIRB). Chapter 7: Preliminary Screening; Chapter 8: Environmental Assessment; Chapter 9: Environmental Impact Review. Part 4 - Regulatory Agencies and Processes ... describes each of the main governmental bodies involved in the assessment and regulation of oil and gas activity in the SSA. ...
