This is the application of Canadian Arctic Gas Pipeline Limited (the "Applicant") to the Minister of Indian Affairs and Northern Development made pursuant to the Territorial Lands Act (the "Act"), and other applicable provisions of law, for a grant of interests in certain lands in the Northwest Territories and the Yukon Territory (the "Territorial Lands"), and for all permits, authorizations and approvals necessary to construct and operate a pipe line and works connected therewith. ... the Applicant requests the Minister to authorize the issue of all permits, authorizations and approvals which the Applicant may require to construct, operate and maintain the pipe line, including, but not limited to, the following: (a) the right to conduct land use operations and to undertake and complete all excavations, road, highway and river crossings, land clearing, fuel movement, equipment and supply movement, barge landing, supplies storage, snow road construction and other operations on sufficient of the Territorial Lands (the "Construction Lands") adjacent to the Right-of-Way and the Facilities Lands as the Applicant may reasonably require in connection with the construction of the pipe line and works of the Applicant, together with the right of ingress and egress at any and all times over, along and to the Construction Lands; (b) the right to have access to and to remove from Territorial Lands the Applicant's requirements for granular and other types of fill necessary to construct and operate those portions of the pipe within the Northwest Territories and the Yukon Territory; (c) the right to temporarily alter or divert, and to use, water located near the Right-of-Way, the Construction Lands, the Facilities Lands and the related facilities sufficient to meet the Applicant's reasonable requirements during the construction, operation and maintenance of its pipe line; and (d) the right to cut and remove for the Applicant's use or to dispose of, all timber on the Right-of-Way, the Facilities Lands and the Construction Lands.
